Insurance Policies/Procedures
The Environmental Health and Safety department at Florida Gulf Coast university is the liaison between the university and the State of Florida Department of Insurance, the Department of Management Service, and commercial vendors for issues related to the types of insurance included in this document.

This document provides a summary of the types of insurance policies available at the university, and the processes for obtaining and making claims. This information does not take the place of reading the specific insurance policies, endorsements, and Statutes.

Aircraft Insurance

No current use at FGCU until someone purchases or constructs a university owned aircraft.

Automobile Collision and Comprehensive Insurance
Toggle More InfoThese are optional commercial policy programs to provide financial protection from damage to university vehicles.
Coverage
These policies provide coverage (minus deductible) to repair damages to university owned vehicles caused by negligence of the operator, or an Act of God.
Exclusions
This insurance is only available for vehicles that are registered, licensed, and titled.
Obtaining Coverage
Departments must notify Environmental Health and Safety in writing (email) of their desire to insure a vehicle under this program. With the notification, include the following information.
- Year, make and model of vehicle
- Cost or current value of the vehicle
- Vehicle identification number (VIN)
- The names of authorized drivers for the vehicle
- Anticipated mileage per year
For all university vehicles other than police vehicles, Environmental Health and Safety will contact Progressive Express directly to request collision and comprehensive coverage for the vehicle.
For all university police vehicles (with a driver's cage), Environmental Health and Safety will contact the Department of Management Services and Arthur J Gallagher Insurance Company at 850-488-8855 to request collision and comprehensive coverage for the vehicle.
Filing a Claim
If another vehicle was involved, begin with the procedures under Automobile Liability Insurance.
Notify Environmental Health and Safety by noon of the following day for assistance in filing the claim. With the notification, include a police report or report case number if possible, photographs (digital pictures) of the damage, and a written summary of what occurred.
For university vehicles other than police vehicles, Environmental Health and Safety will contact Progressive Express Insurance Company at 888-515-3296 and reference Policy #06028584-7 to initiate the claim.
For all university police vehicles, Environmental Health and Safety will contact Arthur J. Gallagher Insurance Company at 1-786-331-1253 and reference policy #74APS083687 to initiate the claim.
Typically, the vehicle owner will need to take the vehicle to an insurance company preferred repair shop for repairs.
Premium
Premiums for vehicle insurance must be paid by the Division (Administrative Services, Student Affairs, Academic Affairs) owning the vehicle.

Automobile Liability Insurance
Toggle More InfoThe state provides auto liability insurance as a part of the General Liability protection through the State Risk Management Trust Fund and the Bureau of State Liability Claims.
Coverage
This self-insurance program provides coverage for claims arising out of the ownership, maintenance, or use including loading or unloading, of any owned, hired or non-owned automobile used by an employee, agent or official volunteer of the university, while acting within the course and scope of conducting university business. NOTE: Workers' Compensation benefits may be reduced by 25 percent if an employee is injured while driving or riding without a seatbelt
Exclusions
This self-insurance program does not cover damages to any university vehicle, nor to any personal vehicle used by an employee, agent or official volunteer of the State, while acting within the course and scope of their office or employment.
university automobiles are available for official university business only. Trips outside of the course and scope of an employee's duties (such as running an errand or to lunch while not in travel status) are not covered. Based on Florida rules and insurance coverage restrictions, students are not allowed to use university automobiles.
Obtaining Coverage
Coverage is provided for all university employees, agents or official volunteers while acting within the course and scope of their employment or responsibilities.
Filing a Claim
University Employee at Fault
A university employee involved in a potential claim through the operation of an automobile, or his or her supervisor, must notify Environmental Health and Safety by noon of the following business day. With this notification, include:
- a police report or report case number
- a completed Non-Employee Incident Report
- the Automobile Accident Report Form
- a statement from the university driver's supervisor stating the driver operating the vehicle while in the course and scope of conducting university business at the time of the incident
Environmental Health and Safety will use this information when filing a claim.
A claim filed for property damage will require two estimates of repair costs from the other party. If the other party requires a rental car, notify Environmental Health and Safety immediately so that we can contact the Division of Risk Management in Tallahassee to make the necessary arrangements.
Environmental Health and Safety will process all of the documentation listed above with a claim form to the Department of Financial Services for final determination. This determination and payment can take 6 to 10 weeks. The other party may choose to have their vehicle repaired through their insurer. Their insurer then files a subrogation claim with the State of Florida. In this situation, Environmental Health and Safety should be provided with the above noted items.
Other Driver is at Fault
Environmental Health and Safety will coordinate in filing the claim with the other party's insurance company. Provide the same information listed above. The Assistant Director of EHS will notify the department on how to proceed based on the procedures of the particular insurer. Environmental Health and Safety gives the reimbursement check to cover repairs to the department that is accountable for the vehicle repairs. However, it is most common for the insurance company (of driver at fault) to issue a check payable directly to the repairing vendor.

Boiler and Machinery Policy
Toggle More InfoThis is an optional statewide commercial policy program to provide financial protection from damage to university property and liability for injury or damages to others.
Coverage
This is a property damage and liability policy covering losses the State Risk Management Trust Fund does not cover including accidents involving any boiler, fired or unfired vessel normally subject to vacuum or internal pressure other than static pressure of contents, refrigerating system, piping with its accessory equipment, and mechanical or electrical machine or apparatus which generates, controls, transmits, transforms or utilizes mechanical or electrical power.

Obtaining
Environmental Health and Safety obtains this insurance through the Department of Management Services. Environmental Health and Safety will also assist in obtaining a certificate under this coverage if requested.
Filing a Claim
Provide a written statement (email) and photographs of the loss to Environmental Health and Safety. Environmental Health and Safety will assist with filing the claim. For claim form click here.

The university pays the premium for this coverage.

Camper Insurance
Toggle More InfoCamper Insurance is avilable to University departments having day or overnight sport and educational camps.
Coverage
Provides benefits for any person enrolled as a camper or participant, as listed on the camp application, and for whom a premium has been paid. This policy will cover any unexpected or unforeseen occurrence which results in bodily injury to an Insured Person while traveling directly, without interruption, to or from an organized activity or program, and while participating in any regularly scheduled and supervised activity.
Plan A Primary Accident Medical Insurance - Day Camps
Plan B Primary Accident Medical Insurance - Overnight Camps
Exclusions
Below are some of the common exclusions that apply to this coverage. Refer to the policy for a list of all exclusions.
- Suicide, self-destruction, attempted self-destruction or intentional self-inflicted injury while sane or insane.
- Voluntarily taking any drugs or narcotic unless the drug or narcotic is prescribed by a Physician.
- Covered Expenses for which the Covered Person would not be responsible in the absence of this Policy.
- Injury caused by, contributed to or resulting from the Covered Person's use of alcohol, illegal drugs or medicines that are not taken in the dosage as prescribed by Covered Person's Physician.
- Damage to or loss of dentures or bridges or damage to existing orthodontic equipment, except as specifically provided in the this Policy.
- Eyeglasses, contact lenses, or hearing aids.
- Travel or flight in or on any vehicle for aerial navigation, including boarding or alighting from: while riding as a passenger in any aircraft not intended or licensed for the transportation of passengers.
Obtaining
Provide completed application and first draft of roster to Environmental Health and Safety, at least, seven business days prior to the camp start date. For example if a camp will start on July 1st, the application and roster is due on or before June 22nd.
The roster should include the name of the camp, the camp administrator, identification as a sport or non-sport camp, the dates of the camp, and the names of the participants. Send an updated roster to Environmental Health and Safety every time there is a change of participants.
Filing a Claim
Environmental Health and Safety will assist the camp administrator in filing a claim under this policy. Click here on this LINK for claim form.
Premium
The premium invoice payment is the responsibility of the camp administrator.

Contractor's Equipment
Toggle More InfoThis is an optional statewide commercial policy program to provide protection against loss, damage, or theft of equipment.
Coverage
This coverage provides protection against all risk of direct physical loss or of damage to insured mobile machinery, mobile equipment, vehicles, and other miscellaneous property subject to a transportation feature, including recreational vehicles and trailers.
Exclusions

Obtaining
Environmental Health and Safety will assist departments in obtaining this insurance through the Department of Management Services. Environmental Health and Safety will also assist in obtaining a certificate of insurance under this coverage if requested. Click on this LINK for COI form.
All equipment over $250,000 must receive prior approval. All equipment valued up to $250,000 is covered automatically if coverage is purchased after the effective date and reported on the first quarterly report submitted immediately after the purchase of the new equipment.
Filing a Claim

Premium

Court Awarded Attorney Fees
Toggle More InfoThe Bureau of State Liability Claims investigates and makes appropriate disposition of court-awarded attorney fee claims filed against the state due to alleged negligent acts of state employees.Coverage
To pay on behalf of the insured, court awarded attorney fees and cost as set forth in Chapter 284, Part 11, Florida Statutes, in other proceedings against the State, in which the State is not a prevailing party. If a State agency files suit against an outside party, the defendant may serve notice to have their attorney fees paid by the State if the court finds in their favor.

Obtaining
Coverage is provided for all university employees, agents or official volunteers while acting within the course and scope of their employment or responsibilities.
Filing a Claim
A party to a suit in any court, entitled to have attorney fees paid by the State must serve a copy of the pleadings claiming the fees on the Department of Insurance in accordance with Chapter 284.30, Florida Statutes.
Premium

Crimes
Toggle More InfoThis is an optional statewide commercial policy program providing coverage for employee dishonesty, excess employee dishonesty, and faithful performance of duty, theft, disappearance, and destruction.
Coverage
Employee Dishonesty insurance provides protection against loss of money, securities, and other property with intrinsic value as a result of a dishonest act committed by an employee that is not otherwise excluded.
Excess Employee Dishonesty insurance provides an extra limit for protection against loss of money, securities, and other property with intrinsic value as a result of a dishonest act committed by an employee that is not otherwise excluded.
Faithful Performance of Duty insurance provides protection against loss of money, securities, and other property with intrinsic value when an employee fails to faithfully perform duties prescribed by law.
Theft, Disappearance, and Destruction insurance provides protection against theft, disappearance, or destruction of money and securities inside or outside Insured premises, other than acts committed by an employee.

Environmental Health and Safety will assist departments in obtaining this insurance through the Department of Management Services.
Filing a Claim

Electronic Data Processing Equipment
Toggle More InfoThis is an optional statewide commercial policy program to provide coverage for computers, peripherals, and scientific or medical instruments.Coverage
This policy covers perils, including theft, not covered by the State Property Insurance Program.
Exclusions
Contact Environmental Health and Safety for current policy exclusions.
Obtaining
The university obtains this coverage for all university inventoried computers and peripherals. Scientific and medical instruments may be included upon request and with approval of the underwriter.
Filing a Claim
Notify Environmental Health and Safety of a loss as soon as is practical, and for assistance in filing the claim. Claims must be filed with the underwriter within 90 days of discovery of the loss. Each claim notification must provide documentation to support the insured value and proof that the equipment was included in the reported total insurable value.
Premium
The premium is paid by the university for computer and peripherals on the inventory. Participating departments may be responsible for their share of the premium for medical or scientific equipment.

Facilities Use Coverage
Toggle More InfoEvents at Florida Gulf Coast university can result in claims for losses associated with an injury or property damage. To protect the university and participants against such losses, adequate insurance or other indemnification is required to schedule events at the university.The State of Florida Division of Risk provides indemnification for liability claims and damages arising from events organized and conducted by official university organizations. The Division of Risk also covers paid university employees and official university volunteers working within the scope of their assigned duties.
The State of Florida Division of Risk does not cover organizations and individuals who do not have official university affiliation (as determined by the Division of Risk). This includes student clubs and organizations, unpaid members of the Student Government, and organizations from outside of the university structure.
Unaffiliated organizations are required to provide Environmental Health and Safety with proof of acceptable insurance for claims and damages arising out of events that they organize or conduct at or with the university. The university's current requirements for acceptable insurance coverage are in Appendix A of this procedure. Insurance is not required for unaffiliated organizations where their involvement does not include significant direct participation in organizing or conducting the event.
To facilitate the insurance process, the university has identified two providers, the university Risk Management Association (URMIA), and K&K Insurance (K&K), for organizations or individuals that need acceptable insurance for events at the university. The cost of this insurance and any applicable deductibles is the responsibility of the organization or individual requesting the insurance. Detailed instructions for obtaining insurance coverage through both of these agencies are in Appendix B of this procedure. To ensure adequate time for verification, EH&S must have the certificate of insurance at least three full business days prior to the event.
A university Vice President or the President's Office may waive these requirements for insurance and assume the liability by notifying Environmental Health and Safety via email or in writing.
Coverage*
The certificate must contain a statement that the insurance will not lapse or be cancelled without notification to the university Environmental Health and Safety department at least 2 business days (48 hours) prior to the effective date of cancellation.
A statement of coinsurance must appear on the certificate including FGCU Board of Trustees as additional insured, and the policyholder must provide a policy endorsement supporting this coinsurance.
The insurance underwriter must be rated as “A” or better by the A.M. Best Company

Obtaining
Insurance described below from either URMIA or K&K is acceptable to the university. URMIA tends to have less expensive rates, but is more restrictive in the type of events it will cover and requires a $250 deductible for property damage claims. This deductible is the responsibility of the person or organization purchasing the insurance. K&K tends to cover a broader range of events and does not have any deductibles, but the insurance premiums tend to be higher.
URMIA refers to its coverage for events as Tenant User Liability Insurance Program (TULIP). Below is the procedure to obtain TULIP from the URMIA website (http://tulip.ajgrms.com)
- Once on the URMIA TENANTS and USERS LIABILITY INSURANCE POLICY page click on, “URMIA Members TULIP Area”
- You will be on the Welcome to TULIP webpage, now click on "Get A Quote" to start the process of purchasing insurance for your event.
- You will be on the location and venue section, please select the State of where event will be held – Florida. It will then ask you to select the location, in the drop box, please pick Florida Gulf Coast university.
- Your selected location will appear, if it’s correct hit NEXT,
- Now, select the dates of your event. You can pick one date or multiple dates for your event. If you made a mistake, under selected dates, highlight the day(s) and remove by clicking on trash icon. Once dates are selected, go to the average daily attendance and fill in the amount, then hit NEXT,

K&K refers to its coverage for events as Short Term Special Event insurance coverage. Once at the KandK Insurance website, the procedure to obtain this insurance from K&K is below.
- Go to the K&K website and highlight Events & Attractions, then go to Short Term Special Events (attendance less than 12,000), and proceed with
- Fill in your information as requested following the K&K instructions. For certificate request section asking for additional insured information, include FGCU Board of Trustees as additional insured.
- The Policy Named Insured is you or your organization.
- Choose the premium for the coverage you want. The university minimum is premium. option 1, but higher coverage is available for additional premium.
- Print out and mail or fax a copy of your certificate.
Environmental Health and Safety must receive insurance certificates at least three full business days before the event.

Federal Civil Rights Liability and Employment Discrimination Coverage

Pays all sums which the university shall become legally obligated to pay, subject to exclusions, arising from employment discrimination actions filed under 42 USC 2000e, Title VII of the 1964 Civil Rights Act, the Rehabilitation Act of 1973 (handicap discrimination), the Age Discrimination in Employment Act of 1967, the Vietnam Era Veteran's Readjustment Act of 1974, and other similar employment discrimination acts and statutes.

Obtaining Coverage
Coverage is provided for all university employees, agents or official volunteers while acting within the course and scope of their employment or responsibilities.
Filing a Claim
File claims through the university's General Counsels' Office. Claims under this program are managed by the Department of Financial Services.

General Liability Insurance
Toggle More InfoThe university, through the State, has sovereign immunity in tort claims. However, the State waives this immunity and does allow filing claims to the extent provided in section 768.28 of the Florida Statutes. The State investigates claims for damages filed against the university due to alleged negligent acts of university employees.
Coverage
This self-insurance coverage includes premises and operations, personal injury, and professional liability. The state is liable for damages for injury, death, or loss of property caused by the negligence of university employees, agents or official volunteers while acting within the course and scope of their employment or responsibilities. From a practical point, this means the insurance applies to any person working within the scope of his or her work who either draws a paycheck, or is an official volunteer registered with Human Resources.
Exclusions
This self-insurance fund does not cover obligations liable under Workers' Compensation, property owned or occupied by the university, professional medical liability, and is not all-inclusive.
Obtaining Coverage
Coverage is provided for all university employees, agents or official volunteers while acting within the course and scope of their employment or responsibilities.
Filing a Claim
A university employee involved with supervision of the location or activity where an incident occurred must complete a Non-Employee Incident Report. Complete this report for all incidents on university property or at a university activity where a non-employee is, or could have been injured or property damaged. Provide this form to Environmental Health and Safety by noon of the business day following the incident.
In the event a claim is made by the non-employee or property owner involved in the incident, Environmental Health and Safety will use this report.
This may be a notice of suit filed against the insured, or a description of the claim from the claimant. If a person wishes to make a claim without filing suit, they should send a letter to Environmental Health and Safety describing the incident and the losses incurred. If there is an incident report from the university Police Department, a copy should be included with the letter. On occasion, the Department of Insurance requests additional information from Environmental Health and Safety and/or the claimant. There must be negligence shown on the part of the university, for a claim to be paid.

Miscellaneous Property
Toggle More InfoThis is an optional statewide commercial policy program to provide protection against loss, damage, or theft of property loaned or leased to the university if the use agreement specifically requires that insurance be provided by the university.Coverage
This policy is to insure exhibits loaned or leased to the university and displayed on campus, and work related office or laboratory equipment while it is transported from another location for new staff. Exhibits are covered only when they are under the custodial control of the university. Equipment the university does not own, but is being utilized by university employees may qualify for coverage if the lease or loan agreement states that the university must provide insurance coverage.
Exclusions
Exhibits loaned by the university to another party must be insured by that other party. There must be a written agreement between the university department and the loaner/lesser that stipulates the insurance requirement. university owned equipment may not be insured on the miscellaneous property policy.
Obtaining
Departments must notify Environmental Health and Safety in writing (email) prior to an upcoming exhibit, equipment usage or move they wish to insure under this program. Notification must include the dates for coverage, a list of the items (and artists' names if applicable) with individual values to be insured, and a copy of the agreement requiring the university to provide coverage. Monthly (based on current insurance term) update reports are filed by Environmental Health and Safety with the Department of Management Services.
Filing a Claim
Report the loss to the university Police Department. Provide a written statement (email), photographs (if available), and a written description of the item to Environmental Health and Safety. Environmental Health and Safety will file the claim in accordance with current insurer's instructions.
Premium
Premium is paid by university. Participating departments may be responsible for their share of the premium.

Ocean Marine Insurance
Toggle More InfoThis optional statewide commercial policy provides coverage for all watercraft owned, leased, or loaned to the university.Coverage
Coverage available includes:
Hull Coverage – Designed to pay physical damage losses caused to the vessel. Such loss or damage may be caused by fire, lightning, windstorm, hail, tornado, collision, sinking, and other perils identified by the policy.
Land Transit - Coverage is extended to include physical damage to the vessel during transit.
Protection & Indemnity Coverage – Indemnifies the Insured (your Agency/university) for any sums which the Insured, as owner/lessee of the vessel, shall have become liable to pay due to losses such as those from loss of life, bodily injury, or illness. This includes collision liability and hospital, medical, and related expenses. This coverage is necessary when a vessel has a dedicated captain or crew.
Exclusions
Coverage is excluded for divers and divers' assistants.
Obtaining
Environmental Health and Safety will assist university watercraft owners or users in selecting and purchasing this coverage and obtaining a certificate of insurance if required.
Filing a Claim
A university employee involved in a potential claim through the operation of a watercraft should attempt to obtain a police, Coast Guard or other law enforcement report or report case number; complete a Non-Employee Incident Report, pictures of the loss, and provide a statement from his or her supervisor stating the operator was operating the watercraft in the course and scope of their employment at the time of the incident. Provide this information to Environmental Health and Safety. Environmental Health and Safety will use this information to complete an Ocean Marine Insurance claim.
Premium
This premium is the responsibility of the department or division operating the watercraft.

Police Officer Accidental Death and Dismemberment

Coverage
Employees of the state who are vested with authority to bear arms and make arrests; and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, boating, or highway laws of the state

Obtaining
Environmental Health and Safety assists the university Police Department with arranging this coverage for university Police Officers.
Accidental Death and Dismemberment Beneficiary Form

Property (Building and Contents) Insurance
Toggle More InfoThe Florida Division of Financial Services, through the Division of Risk Management, provides insurance coverage for university owned buildings and their contents through the State Risk Management Trust Fund Program (Fund). The Fund will cover university property (contents) in leased buildings, and can insure a leased building if the lease agreement requires such, the university is leasing the entire building, and approval is obtained from the Fund prior to signing the lease.
Coverage
The Fund provides protection against direct loss by fire, rental income, lightning, windstorm, hail, explosion, riot, civil commotion, aircraft, vehicles, smoke, flood, sinkhole, and by removal from any premises endangered by one of the perils insured against. There is a $500 deductible for losses due to flooding, and a $2,500 deductible for all other covered losses.
Exclusions
The Fund does not cover personal property, loss by theft, currency, securities, manuscripts, museum collections, artifacts, livestock, and other items similar in nature to these listed exceptions. This policy does not cover losses due to flooding from plumbing or other maintenance issues.
Obtaining Coverage
It is essential that all university property be listed and insured with the Fund in order to obtain coverage in the event of a loss. When verifying the location of new equipment to FGCU Finance and Accounting, it is imperative that the equipment locations be the physical location of the equipment, not the address of the purchasing department. Departments must inform Finance and Accounting whenever the movement of property between buildings or a new purchase greatly affects the total contents value of a building.
Environmental Health and Safety will obtain coverage for newly constructed buildings when Facilities Planning provides a copy of the certificate of substantial completion, the building valuation (as defined by the State), and the building specifications for size and use. Coverage for leased buildings requires permission obtained from the Fund through Environmental Health and Safety prior to signing the lease.
Filing a Claim
To make a claim in the event of a loss, notify Environmental Health and Safety with a written (email) report of the loss and the value of the contents, or cost for building repairs or replacement. Environmental Health and Safety will file the claim with the Fund. Environmental Health and Safety must report claims to the Fund within ninety (90) days of the date of the loss.
Premium
The Department of Financial Services calculates the premium based on intended use of the building, the contents, and rental income, if applicable. The premium is paid by the university.

Specialized Fine Arts Exhibits

Coverage
This policy provides coverage for unique fine arts on loan or owned by the university including museum collections, fine art, murals, stained glass, and sculptures, and covers all risk of direct physical loss or damage to insured property.

Obtaining
Environmental Health and Safety will assist departments in obtaining this insurance through the Department of Management Services.
Filing a Claim
